Key Insight: Where, in response to a request for its board of directors? emails, defendants did not ask directors to search their emails but rather determined through a series of questions that no unique emails existed and argued that the emails were already produced when they produced the ?sender-side versions,? court found that the added production would not be overly burdensome or expensive and ordered the production of any emails reasonably related to the relevant request

Key Insight: Where plaintiff represented that defendant had not fulfilled production obligations pursuant to the court?s order, court ordered defendant to respond to questions as to the completeness of its production and other related topics and affirmed its prior order requiring the re-production of 35,000 pages of emails previously produced in hard copy, despite the alleged burden of doing so; court also ordered defendant to respond to questions regarding the production of ESI, including spreadsheets, previously produced in hard copy and noted, ?Understandably, taking an electronic document such as a spreadsheet, printing it, cutting it up, and telling one’s opponent to paste it back together again, when the electronic document can be produced with a keystroke is madness in the world in which we live.?

Jneid v. Tripole Corp., 2009 WL 4882654 (Cal. Ct. App. Dec. 17, 2009)

Key Insight: Appellate court reversed the judgment of the trial court and remanded the case for a new trial upon finding that defendant ?did not act intentionally? when if failed to produce certain documents before trial and that the evidentiary and issue sanctions imposed, including preclusion of use of certain documents, preclusion from introducing certain evidence, preclusion of certain arguments, and an adverse jury instruction, were ?more severe than necessary? where an order for defendant to pay all costs incurred by the completed trial (as suggested by defendant) was sufficient to rectify the prejudice to the plaintiff; on remand, court ordered trial court to determine the cost incurred by plaintiffs and cross-complainant in connection with trial and the costs incurred because of the late production of documents and for defendant to pay such costs

Clearvalue, Inc. v. Pearl River Polymers, Inc., 560 F.3d 1291 (Fed. Cir. 2009)

Key Insight: In an opinion providing an extensive discussion of the court?s authority to sanction pursuant to Rule 37 and its inherent authority, the appellate court confirmed the trial court?s imposition of monetary sanctions finding that appellant-plaintiffs acted in bad faith by failing to produce relevant test results as evidenced by the content of several emails produced for the sanctions hearing (and other evidence) but overturned the trial court?s sanction of striking plaintiff?s claims pursuant to its inherent authority upon finding that plaintiffs? discovery abuses were not sufficiently egregious to warrant such sanctions; appellate court also found trial court?s reliance on inherent authority to strike plaintiffs? pleadings was misplaced in light of the applicability of Rule 37

Key Insight: Court declined to compel production of detailed information regarding defendant?s electronically stored information and efforts to search the same where such production would be ?extremely burdensome? and unlikely to be of significant value, especially in light of defendants prior production of information regarding the relevant information systems and searches and because plaintiff had not established prejudice as a result of alleged deficiencies in defendants production, among other reasons; footnote addressing format of production reasoned hard copy production of ESI was acceptable because hard copy was a reasonably useable format, because production in electronic format would be burdensome, and because plaintiff?s counsel was already familiar with the hard copy production such that production in electronic form would be ?redundant and wasteful?

Key Insight: Where plaintiff deleted an ?extremely significant? number of data files from his personal computer despite notice of his obligation to preserve and was thus sanctioned by dismissal of his case, trial court did not abuse its discretion in concluding plaintiff?s actions were not in good faith, particularly in light of the number of files deleted, and properly considered alternative sanctions before imposing terminating sanctions, despite the trial judge?s failure to ?expressly recite? those alternatives on the record; court?s denial of attorneys? fees/monetary sanctions was no abuse of discretion where the court ?dealt appropriately? with plaintiff?s conduct by dismissing the case and where the refusal to impose additional sanctions was ?not unreasoned or unprincipled?

Key Insight: Where defendant?s response to plaintiffs? discovery requests encompassed as many as 20 supplemental responses over 5 years, including the production of 1,487,824 pages of electronically unsearchable ESI 5 years after plaintiffs? first request (which plaintiffs paid to convert to a searchable format), court found defendant?s efforts ?did not represent a good faith effort to comply with the rules of practice or the case management orders of this court? and violated ? 13-14(a) of the Practice Book and accordingly ordered sanctions including allowing re-deposition of witnesses at defendant?s cost, reimbursement of plaintiffs for conversion costs, and payment of plaintiffs? attorney?s fees
