Key Insight: Where defendant did not conduct a reasonably diligent search for numerous categories of documents that court ordered be produced, did not conduct a reasonably diligent search for ESI, and did not suspend its document destruction policy or otherwise take adequate steps to preserve documents, among other forms of relief court ordered defendant to retain at its own expense an outside vendor, to be jointly selected by the parties, to collect responsive ESI; court further indicated it would impose $125,000 in sanctions representing reasonable amount of attorneys’ fees expended by plaintiff as result of defendant’s discovery misconduct

Key Insight: Where defendants used “Window Washer” disk scrubbing software on hard drives just days before they were to be turned over to forensic expert, and also performed “mass deletions” of electronic files, court found that defendants’ intentional actions evidenced a serious disregard for the judicial process and had prejudiced plaintiff; court entered default judgment in favor of plaintiff and shifted to defendants plaintiff’s costs, attorney’s fees, and computer expert’s fees relating to motions for sanctions and forensic imaging and recovery of defendants’ hard drives; jury trial to proceed solely on issue of plaintiff’s damages

Bishop v. Toys ?R? US-NY, LLC, 2007 WL 2042913 (S.D.N.Y. July 13, 2007)

Key Insight: Overruling plaintiff’s objection that magistrate judge’s sanctions order did not go far enough and should have required defendant to retain a computer forensic expert to examine surveillance equipment to determine whether deleted images were recoverable, court found that order was neither clearly erroneous nor contrary to law since defendant had produced affidavit of individual who personally installed and serviced the surveillance system who stated that he inspected the surveillance data system and determined that the images were not recoverable

Nature of Case: Customer asserted federal civil rights claims arising from his detention by store security guards

Hsieh v. Nicholson, 2007 WL 2438315 (N.D. Cal. Aug. 23, 2007)

Key Insight: Finding any request for spoliation sanctions unwarranted, court denied plaintiff’s motion to compel production of emails where defendant made adequate showing that, after reasonable search and inquiry, he was unable to locate requested emails, plaintiff submitted no contrary evidence, and plaintiff identified no flaws in defendant’s search methods

Key Insight: Court granted in part plaintiffs’ motion to enter and inspect crossing area and directed defendant to arrange for an employee to be on-site during the inspection to provide a download of all available date from event recorders and other components and equipment of the crossing signal system stored on-site; court denied motion to compel production of particular employee’s computer since the computer had been returned to a vendor and defendant had already produced a copy of computer’s hard drive

Wood Group Pressure Control, L.P. v. B & B Oilfield Servs., Inc., 2007 WL 1076702 (E.D. La. Apr. 9, 2007)

Key Insight: Court directed defense counsel to file supplemental memorandum regarding her communications with defendant regarding supplemental discovery responses and preservation of evidence and to provide documentation of same for in camera inspection; court further directed defendant to make available key player’s hard drive for forensic examination

Nature of Case: Misappropriation of trade secrets

Healthcare Advocates, Inc. v. Harding, Earley, Follmer & Frailey, 497 F.Supp.2d 627 (E.D. Pa. 2007)

Key Insight: Spoliation sanctions were not warranted for defendant’s failure to preserve copies of screenshots that may have been automatically stored in temporary cache files of defendant’s computers, since plaintiff’s counsel’s preservation letter said nothing about preserving temporary cache files, defendant had no reason to believe such files were relevant, files were deleted automatically and not through any affirmative action by defendant, defendant produced forensic images of its hard drives, and plaintiff established little if any prejudice from loss of cache files

Nature of Case: Copyright infringement and violations of the Computer Fraud & Abuse Act

Electronic Data Involved: Copies of archived website screenshots automatically stored in temporary cache files of defendant’s computers

Agassi Enters., Inc. v. Target Corp., 2007 WL 4441195 (D. Nev. Dec. 11, 2007)

Key Insight: Granting preliminary injunction, court further ordered defendant to “preserve all documents and other evidence (including, but not limited to, electronic documents such as email relating to its use of the AGASSI name . . .” and, within 30 days of the order, to file and serve a report detailing the manner and form in which Target complied with the preliminary injunction

Nature of Case: Trademark infringement

Phoenix Four, Inc. v. Strategic Res. Corp., 2006 WL 2135798 (S.D.N.Y. Aug. 1, 2006)

Key Insight: In follow-up to earlier decision awarding sanctions for discovery failings (Phoenix Four, Inc. v. Strategic Res. Corp., 2006 WL 1409413 (S.D.N.Y. May 23, 2006)), court awarded Phoenix its attorney’s fees and costs associated with bringing the motion for sanctions in the amount of $45,162, to be paid equally by the SRC Defendants and their law firm; court further ruled that the SRC Defendants’ share ?may not be borne by their insurance carriers?

Nature of Case: Investment company sued former advisor for breach of fiduciary duty, common law fraud, and negligent misrepresentation
